These terms define our mutual legal obligations. They apply to your use of our services.
When we refer to Appointt, “Operator,” “we,” “us,” and “our” in these terms, we mean Phinesoft GmbH.
When we refer to “services,” we mean the services, apps, websites, and other products of Appointt.
When we say “you” or “your,” we mean you. If you are accessing our services on behalf of a legal entity (e.g., your employer), you agree that you are authorized to bind that entity to these terms, and “you” and “your” refer to that entity.
Additionally, our Privacy Policy applies to the use of our services. It is part of these Terms of Use. Please read these policies carefully. We have tried to make them clear and simple, and they contain important information about your use of our services.
Scope of Application
These Terms of Use govern the use of the platform “Appointt” (hereinafter referred to as “Platform”) by the users. The use of the Platform is exclusively based on these terms. Deviating or supplementary terms of the user shall not apply unless their validity is expressly agreed to in writing.
Service of the Platform
The platform “Appointt” allows users to manage appointments, make reservations, and share calendar information. The platform is intended for both personal and commercial use by users.
Registration and User Account
Registration is required to use the platform. The user is obliged to provide truthful and complete information during registration. The user account is personal and may not be shared with third parties. The user is responsible for keeping their login details confidential and is liable for all activities performed under their account.
Data Protection
The platform “Appointt” processes personal data of users in accordance with the provisions of the General Data Protection Regulation (GDPR) and German data protection law. Further information on data processing is contained in the platform's Privacy Policy.
Platform Availability
The platform is offered subject to availability and technical capabilities. No guarantee is given for the uninterrupted availability of the platform. In particular, temporary restrictions may occur due to maintenance work or technical issues.
Liability
The liability of the operators of the platform “Appointt” is limited to intent and gross negligence. Liability for damages caused by slight negligence will only apply if essential contractual obligations are breached, the fulfillment of which is necessary for the proper execution of the contract and on whose compliance the user regularly relies.
User Fee and Terms of Payment
For the commercial use of the platform “Appointt,” user fees may apply. The amount of the fees and the payment terms will be specified in a separate agreement or directly on the platform.
Changes to the Terms
The operators reserve the right to change these Terms of Use at any time. Users will be informed of any changes in a timely manner. Changes to the Terms of Use are considered approved if the user does not object within a reasonable period.
Final Provisions
The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Should individual provisions of these Terms of Use be invalid or become invalid, the validity of the remaining provisions shall remain unaffected. Instead of the invalid provisions, the statutory regulations shall apply.
